Chairman Stephanie Wilkie called the meeting to order at 7:08 P.M in the Town Hall Auditorium. Present were Clerk Susan Sullivan, Director of Public Health Thomas Carbone and Recording Secretary Dawn Cathcart. Vice Chairman Edward Sheehan was not present
Kan Lania from Cuoco and Cormier appeared for this hearing. Mr. Lania stated that the variance request was approved a month ago, but one of the conditions was that this site not be in the Zone II area for the Tewksbury Hospital Wells. This site does fall in the Zone II area and that is why this is back. There are requirements that deal with Title V relating to Zone II areas. This system meets the requirements as stated in the Massachusetts DEP 310 CMR 15.000, Section 15.214 and 15.215. The law states that the system shall receive no more that 440 gallons per acre; between the two sites there are almost 2 ½ acres and there would only be 530 gallons of waste per day. This is under the 880 gallons allowed.
Mr. Carbone stated that he agrees with Mr. Lania’s interpretation. The only issue is the paperwork and this would be addressed at DEP.
Ms. Wilkie asked if the Planning Board needs to be involved, since it falls in Zone II. Mr. Carbone replied no, this is a septic system and the issue falls under Title V, not Zone II. This development project was also started before the bylaw was passed. Ms. Wilkie asked if Mr. Carbone felt comfortable with this. Mr. Carbone replied he did.
MOTION - Ms. Wilkie made a motion to approve the variance subject to the same conditions as the original approval. The motion was seconded by Mrs. Sullivan and unanimously voted 2-0.
Mr. Carbone stated that there are two outstanding issues and they are very minor. The conditions expire on Saturday, so this hearing should be closed. Ms. Wilkie asked what the last two issues were. Mr. Carbone stated that the first issue was the banister on the stairs of the upper deck. They fixed it, but it didn’t comply with code. The second issue was an interior door, which they are in the process of replacing. Ms. Wilkie asked if these two issues would be completed by Saturday. Mr. Carbone stated that he did not know.
Ms. Wilkie stated that the hearing couldn’t be closed, until Mr. Sheehan returns, due to the fact that Mrs. Sullivan is related and has not taken part of the hearing.
Mr. Carbone stated that most of the fees stayed the same. The only exceptions were the Perc Test/Deep Hole Witness Fee which was changed from $60 to $75, Trailer Park Permit which changed from $25 to $50, and Board of Health Public Hearing which changed from $40 to $50.
MOTION - Mrs. Sullivan made a motion to approve the 2003 Fee Schedule as presented. The motion was seconded by Ms. Wilkie and unanimously voted 2-0.
MOTION - Ms. Wilkie made a motion to approve the Board of Health Minutes of September 5, 2002. The motion was seconded by Mrs. Sullivan and unanimously voted 2-0.
The minutes of October 3, 2002, were tabled to allow them to be amended to show that Mrs. Sullivan did not participate in the Kevin Sullivan hearing.
Ms. Wilkie stated that she has received email and phone calls regarding the Handi House porta-john company that is primarily located in Foxboro. They are cleaning porta potties on Hillman Street. Ms. Wilkie stated that she drove by and there is a strong odor. Ms. Wilkie stated that she witnessed porta potties being cleaned on the ground and the water and chemicals are going into the ground and there are cleaning residue on the ground. This site may fall within the Zone II and we should regulate them.
Mr. Carbone stated that he talked with a contact at DEP, Claire Golden and the issue is not only the cleaning of them, but also the transportation of the waste. The Board of Health may require a site assignment. If the Board of Health can’t regulate them, then DEP would be able to. Ms. Golden is going to get back to us in a few days.
Ms. Wilkie asked that Mr. Carbone let the Board of Health know when he hears back from DEP.
Director’s Report
Mr. Carbone stated that the Tobacco Program was cut again by the Governor and on November 30, 2002 the contract will be severed. All the compliance checks have been cancelled. This makes the Town lose the ability to do good things. Other states have modeled their programs after Massachusetts and it’s a shame that this was cut.
Ms. Wilkie stated that we would also lose the fines that were associated with the violations. Mr. Carbone stated that most of our merchants are good. Ms. Wilkie requested that Melissa get another invoice from the silk screener for the T-Shirts, since she can’t find hers.
Mr. Carbone stated that Environmental Day is this Saturday, October 19, 2002. Residents can bring batteries, large metal objects and household hazardous materials. The time is 9:00 AM to 1:00 PM.
Mr. Carbone stated that the next meeting is November 21, 2002.
